- Ensure all leased homes remain compliant with the existing policy (Development Area Declaration, Article 2, Section 2.2)
- Clarify owner responsibilities when leasing
- Provide structure for tenant registration and documentation
- Protect the integrity of our governing documents
- Cover administrative costs associated with rental oversight
- This policy would apply to all lots within the Association.
Key Highlights of the Draft Policy
Lease Registration & Addendum
Owners would be required to:
- Submit tenant contact information to the Association
- Provide lease start date and term
- Complete the Association’s Lease Addendum
- Provide a copy of the lease upon request (with sensitive information redacted)
Lease Administration Fee
An annual $300 Lease Administration Fee would apply to leased properties.
According to the draft (Page 2), this fee covers:
- Rental registration and monitoring
- Leasing portal setup and management
- Administration when tenants move in or out
- Amenity access updates
- Document distribution and communication management
Owner Responsibility
Leasing does not relieve an owner of responsibility.
The draft specifies that:
- Owners remain responsible for tenant compliance
- The Association may enforce governing documents against tenants
- Enforcement costs related to tenant violations may be charged back to the owner
- The Association is not liable for lost rent resulting from enforcement actions
Amenity Use
Under the draft policy (Page 2, Section 3):
If a lot is leased, the Owner would not be entitled to use the common area amenities.
Enforcement & Fines
The draft establishes specific fines for:
- Failure to complete the Lease Addendum
- Leasing for less than six (6) months
- $50 initial fine for failure to complete required documentation, plus $50 per week for continuing violations
- $250 initial fine for leasing under six months, plus $250 per week for continuing violations
Existing leases in effect prior to adoption would not be affected by the policy until a renewal or new lease is enacted on or after April 1, 2026.
